The Format (medium of expression) of the intellectual

“INTERNET OF THINGS” DEVICES SUCH AS REFRIGERATORS/MICROWAVE
OVENS/VEHICLES/DIGITAL GLASSES/TV SETS AMONG OTHER DEVICES WITH INTERNET
ACCESS) aims at making the Internet easier and closer for users in their daily
lives.
It is no news that e-commerce websites, even with
payment by the Internet, already exist. However, the difference with ©Gownow
is that it centralizes actions and functions that used to be performed by the
customers demanding their time and patience. ©Gownow eliminates unnecessary functions and saves
the users’ time. It is important to point out that what is expected from
copyright protection is the protection of the format (medium of expression) of
the intellectual creation/innovation/work, the central idea of which is the
electronic commerce. However, the purpose here is not the registration of
underlying ideas such as “electronic commerce”, “products and services search
application” or other isolated elements, but simply the ©Gownow specific
format in its essence and the one-of-a-kind intellectual creation described
below.
As an example, nowadays if a customer wants to buy a
pizza (or any other product or service) from home, they need to look up in the
directory for a pizzeria, call until they find a 24-hour delivery pizzeria, and
place the order by phone. In case the customer chooses to use the Internet,
they will have to find a local pizzeria in the Internet search engines, find
the pizzeria’s website and write down the phone number, place the order by
e-mail, call, or find the product in search engines and be redirected to the
pizzeria’s website, or install a restaurant-search application, or install a
mobile directory application (similar to Telelistas
mobile), which downloads the phone number to your cellphone, and then the
customer will place the order, or they will have to install a number of random
apps (purchase of food, taxi, etc.).
©Gownow skips all these steps and makes the purchase/reservation/etc. more
efficiently, doing what the customer would have to do by himself/herself – like
finding a local service provider or retailer – when he/she needs, 24 hours a
day. With ©Gownow, the customer will find the service provider and pay
for the service or product, which will then be delivered to customer. It is
also possible to find collective purchase options (not necessarily).
©Gownow/website
possible layout: *the display and order of items are for illustration
purposes only. Elements may be added or removed without changing the essence of
the protected format.
In the first field, the customer will type the
country; in the next one, the city, and in the third field, the product or
service. With these pieces of information, the website can specify the
database. It will search for a product or service registered with ©Gownow
in a specific city. Fields with data can be programmed to search in just one
city or even in a region of the city, or within a specific distance range (1km,
3km, etc.). It can even activate the cellphone GPS or the computer IP, or
devices alike, to automatically detect the place.
The person will then check the
address in the map through electronic mapping systems. The address is recorded
so that it can be informed to the retailer’s delivery. A message is sent to the
retailer with the map, the order and its code. As soon as possible, the
retailer replies, from a computer or any mobile electronic device, informing
the price and the estimated time of delivery or service provision and other
pertinent information.
©Gownow gives to the users these two pieces of information
(price and delivery time), which in their turn are provided to ©Gownow
by the retailer or the company’s online customer service.
In case the customer agrees, he/she will click on
“Confirm order/ Yes”. The confirmation of the order will automatically generate
a code; depending on the city, country or delivery place (this can be
optional). The customer then enters the credit or debit card data and pays via
Internet (or cash, or any other method of payment existing, or that may exist
in the future). The customer can also register beforehand to avoid having to
repeat the data. It is possible to insert other fields with the possibility of
access by voice, Skype, whatsapp, chat or alike (instant data communicators) or
speech recognition.
©Gownow then generates an order report
(this can be optional) with a code to be printed by the retailer. Having printed
such report, the retailer delivers the goods to the customer who must sign it
in a specific field. Based on this signature and on the code generated in the
order the retailer will receive the amounts through the ©Gownow account. In case the retailer fails to
deliver the order, ©Gownow asks the client
for a refund account number, that is, in case the order is not
delivered the customer will have the money back, and ©Gownow will apply a fine to the retailer (this is
optional in case the payment is made through ©Gownow payment method).
When subscribing a product or a retailer, ©Gownow may enter
a photo of the product or service so that the customer knows what he/she is
buying, and to enable the customer to compare prices. This also allows the
customer to see who is online.
©Gownow is a complex engineering information format (article 7, sections X, XII
and XII of Law 9610/98), which uses many tools at the same time, such as the
Internet (data transfer), search modules, remote communication modules,
artificial intelligence (optional), search module in databases, automatic code
generation (optional), automatic messages through the Internet
(whatsapp/MSN/SKYPE/VOICE/CHAT OR SIMILAR INSTANT COMMUNICATORS), speech
recognition systems (optional), electronic payment systems (optional), a user’s
account (to register previous purchases with the purpose of repeating the
purchase with less effort from the customer, such as favorites or “repeat
order”), cell systems of communication (in case of using portable apparatuses
of communication), and otherwise. (Some of these elements may be removed or
entered without changing the essence of the intellectual creation).
In case the user does not have a computer, he can get
access via cell phone or any other electronic device with access to the
Internet such as tablets, iPhone, and otherwise, or others that may come to
exist with access to the Internet (the Internet of things) such as microwave
ovens/refrigerators/vehicles/digital glasses (like Google Glass)/TV sets/video
games, or otherwise. Customers just need to have a credit or debit card (or
have it previously registered in the website, or another method of payment) and
a telephone and send a message from their cell phone with the predetermined
codes and follow all the directions that will be sent to them according to the
order placed (optional).
A practical example of this is
how ©Gownow may revolutionize the use of information technology. For
instance, a customer has a credit card or cash and a cell phone. The customer
is driving on a road and runs out of gas. From his cell phone and using his
credit or debit card (or cash) it is possible to buy gas in the same city where
he is, and have the gas delivered to him by the gas station dealer at the point
of the road he is on (in case this option is available).
Another example: you are at home, you have a computer
or a smartphone (or a similar device) and a credit card. Alternatively, you are
registered in the website, but you don’t want to go out to eat. From your
computer, through the website or the app in your cell phone you can find what
you want, order and pay (as the case may be). In a few minutes, the retailer
delivers your order with no need of installing several apps.
The aim of ©Gownow is to centralize delivery services, or service providers, or products
that can be delivered to the customer. The services may be food delivery,
medicine delivery, search for apartments, hotels, taxis, tow trucks,
locksmiths, setting appointments with independent professionals such as physicians,
veterinarians, or lawyers among others, or the rendering of services even when
instant
delivery/reservation/purchase/etc…is not available such as tickets,
hotel reservations, delivery of products such as electrical appliances, books,
and otherwise, that is, the same products offered in electronic or ordinary
directories or in many websites.
Although it is a complex format with a number of
components, it is very convenient to the user. The service may be paid in the
following manners (optional, since the service may be free for a period of time
or for the whole time): when registering the clients would pay a monthly fee
which may vary according to the use - the more orders, the less expensive the
fee will be; or, the retailers would pay to be registered in the ©Gownow
database; or the retailers would pay a higher fee according to the order they
would appear in the customer’s search, or also, for each order placed a fee
would be charged. Other ways to generate revenue would be through advertising,
order in the searches, etc.
Below there is a description of
the ©Gownow screens. *The order of
items does not change the format protected by copyright. Flowcharts are for
illustration purposes only. Article 7, sections X, XII and XII of Law 9610/98.
Phases may be removed or added without prejudice to the essence of the format
of the innovation/creation/intellectual work:
The format is the same for the
cell phone. A simpler version may exist by sending messages via SMS, whatsapp
or Skype, voice or similar instant communicators instead of browsing in the
Internet, which still involves high costs. In order to make this feasible it is
necessary to use the system together with a system that sends messages through
SMS, whatsapp or similar instant communicators without changing the format
substantially. The programming, the technical language and the technical
elements used may change without interfering with the ©Gownow protected format, because it has the
originality and creativity inherent to this innovation.

intellectual creation format. Some elements may be changed, included or removed
without interfering in the essence of the format:
The user accesses the website
(1) from a computer, cell phone or any device with access to the Internet
(TV/MICROWAVE/FRIDGE/ VEHICLES/ETC…) (or he can install the application) and
types the website address in field 1. (2) He creates a login with a password in
field 2 (3) agreeing to the terms of use and with the agreement (when
downloading the application or when registering). The user then enters his
credit card number to make the future purchases (optional). This will be kept
in the website’s customer database (4) (this
item is optional because of the many ways to make payments, including cash at
the moment of delivery or service, or as both customer and provider agree
upon).
Having
registered or accepted the terms of use, the user/customer then accesses field
4 (5) and types the country where he needs a service or product or starts the
GPS in his cell phone, or his computer’s IP or similar device. Then he enters
his state (6) and the city (7). The user may also set up the city he wants the
product/service beforehand skipping these steps afterwards; or he can simply
type his Zip Code beforehand; or these steps may be left out in case the
customer decides to be located by the GPS in his cell phone or his computer’s
IP (or similar device).
In field 7 (8) the user selects the product or service
available by accessing the website’s database, which can be collective purchase
(not necessarily), products or services available, among other options. The
product or services menu may be developed within the ©Gownow format, or they can be accessed in the
websites of the retailers or service providers. The products available will
appear in the screen as available online
(10) or offline and then photos
or videos or other descriptions of the product or service will appear.
The customer then decides
whether to select that product/service or to go on searching. In case the
client has selected a product/service, he will then go to the next step, which
will be selecting the company in field 8 (9) that is online or not in order to
exchange information through a kind of “commercial whatsapp” (instant
communicator) or alike, or access the menus or websites as the case may be.
After having selected a
product or service to be rendered and knowing the retailer/service provider is
online, the customer will open a sub-application that can be similar to Google
maps in order to look up in field 9 (11) (optional) the address where the
product/service will be delivered/rendered.
This address with the product/service to
be delivered/rendered is then sent to the retailer/provider in real time via
the Internet (field 5) of vendor’s access (12).
The retailer/provider receives the order and according
to their availability will reply “delivery time” (field 10) and “price of the
order” (field 12) by sending instant messages such as MSN Messenger/Facebook
Messenger or similar services, or also by SMS, as the case may be, or by a
model similar to whatsapp or Skype, or voice by the Internet, or by sending
audio or alike with fields that provide that the customer and the
retailer/service provider clarify their doubts. The chat or communication may
be open or limited in time (“x” minutes) or space (“y” characters like twitter)
or in both ways in order to avoid that retailers/providers waste time helping
customers.
The retailer (or
online operator) then sends the “delivery time” and “price of the order” field
6 vendor’s access (13), the customer receives this information in field 12 (15)
and other information deemed relevant.
The customer confirms the
order (16) and the price generating the purchase order, or customer and
retailer/provider decide which payment method is to be used. The payment method
may be the one used within the ©Gownow format or not.
Numbers (17) through (22) are
about the payment made via cell phone (which can be
any payment method existing or that may exist in the future).
Delivery may be within the
format indicating where the product is in case this option is available.
Distant delivery made by transporters or by mail, or otherwise, may be traced
within ©Gownow.
In case of repeated purchase, the format may save the
same order set up such as product or service, payment methods, place of
delivery among other information and do everything automatically in the next
purchases in a species of function (repeat purchase/order).
It is important to point out that many of these phases
may be skipped without changing the essence of the format, if the user, for
instance, uses ©Gownow through
automatic voice recognition. In such a case, the user may interact with the
artificial intelligence of the format, which would recognize the product or
service the customer wants only by speaking in the cell phone or similar audio
capturing devices. ©Gownow users could say phrases like, for example:
“‘X’ brand dealer in city ‘Y’ to appoint a tune up for vehicle ‘Z’.” Or, for
example: “medicine ‘x’ for prompt delivery in my city”, or “set an appointment
with an orthopedist in city ‘X’ providing ‘X’ health plan”; “Buy air/bus
tickets from city ‘X’ to city ‘Y’ on day ‘Z’.”; “Reservation for dog wash at
schedule ‘H’.”; “Hotel reservation in city ‘X’ with price between ‘Z’ and
‘F’.”; “Buy/Rent apartment in ‘Z’
neighborhood in my city with real state agency in a distance of ‘Q’ km/miles
range.”; “Lease/Buy vehicle ‘T’, year ‘F’, with price between ‘N’ and ‘M’.”;
“Law/Accounting/etc. office specialized in ‘R’ in a ‘S’ Km/miles range”; among
a number of possibilities and combinations of information. In this case, ©Gownow
would search for the product or service by means of automatic recognition
of phrases and the ©Gownow artificial intelligence would send such
information automatically if they were found in the search and if the service
or product were available at the moment they are online or offline as desired
by the user/consumer. ©Gownow would convert the customer’s phrase (audio
capture) into letters and data and would forward them to the service provider
selected by the customer/user, who could reply to the information received and
convert them back into audio to the user (optional).
Repeating the purchase in
audio would be even simpler. The user would simply enter ©Gownow, go to
the purchase historic and say “repeat order “X”.
It is interesting to point out that ©Gownow could interact with different programs and
artificial intelligences, among others. For instance, in a fridge with
“Internet of things” the user would be able to program the purchase of products
in the supermarket with automatic payment and delivery. Additionally, the
user’s car could be programed to appoint a tune up, through ©Gownow, as
soon as a defect was identified, or as soon as a certain mileage was reached,
among many other examples. The automated inventory of a
store/hospital/company/etc. could issue an automatic purchase of products or
services at ©Gownow as soon as the quantity of supplies are down.
Thus, other machines and not necessarily a human user could program ©Gownow.
Alternatively, a human user could first program it and then it would repeat the
action automatically.
Current difficulties of e-commerce
The main problem with
e-commerce nowadays is that products are everywhere in the country and there
are a huge number of websites and applications. Goods from everywhere appear
before the consumer, and, besides this, the consumer has to make a subscription
in several websites without even knowing whether they are safe or not.
Furthermore, there are a number of applications for a number of things that
could be combined in a single format, although more complex (but simple to be
used by the consumer).
Another problem is that the
commerce in the city where the person lives is not always computerized nor is
it convenient.
Thus, when the person wants to
search for service providers or for products in his/her own city it is
necessary to search for the store’s website, when there is one, or to look up
the telephone number in a directory, an electronic directory, or an electronic
directory application.
It is possible for the consumer to install an
electronic directory application (similar to telelistas mobile application). The customer searching for a
product in his/her city will find the phone number to be be registered in the
customer’s own cell phone when he/she clicks on it.
The difference of ©Gownow from the
formats above mentioned is that the customer will have more options than simply
finding the retailer/service provider and calling from his/her cell phone. The
current options stop here, because it is not possible to know whether the
service provider will help the customer or not. Besides, it is not as practical
as ©Gownow.
After searching for the
service provider or product in a sort of database similar to those of
electronic directories and directory applications and clicking in the service
provider’s number, many options will be available, such as: Call/Add
“Commercial Whatsapp Gownow1 ”[1]/Open
call via Skype (or similar)/Send SMS/Send e-mail/Open chat/voice call, etc.
(optional). In this case, the format will show one of the most important
elements of the innovation: whether the service provider is online and whether
it is ready to help the customer in that moment. The current directory
applications cannot guarantee that the customer will get the service or product exactly because of the lack of this innovation that is
present in the ©Gownow format.
If there were a
website/application with this format, it would not be necessary for retailers
to have their own e-commerce websites in their own cities or region.
Many companies
or independent professionals working only in their cities or region do not find
a good reason to be in the Internet, because at the moment only big stores
count on a logistic system to serve customers in many cities.
The main purpose
of the ©Gownow format is to bring local and regional commerce into the
Internet making life easier for either small or big retailers and service
providers in an instant manner, which the current electronic directories
websites and applications cannot do.
Another
application of the ©Gownow innovation is that the
retailer/vendor/independent professional/service provider/supplier or similar
traders may receive the orders in their electronic device (cell phone, Ipod,
among others) without necessarily be in a place with a computer (there is also
the option of communication between cell phone > PC and vice-versa).
The
advantage for the customer is that there is no need to install a number of
applications, because ©Gownow would be something like Google (example of
Internet browser) mixed with commercial Whatsapp (example of instant
communicator) of delivery and service provision apps as personal assistants
such as Google Now (example of personal assistant in cell phones). This would
be a totally unexplored and creative innovation.
The problem
with the current whatsapp is that only known contacts can be added and with ©Gownow
it will be possible to add unknown
contacts, since there will be a search option. This way, ©Gownow will
bring customers and retailers/service providers closer in their need to
communicate in an innovative and practical way. Another element in the format
is that, for example, Whatsapp may be opened in the computer and communicate
with someone in a cell phone or vice-versa. This similar option could also be
available in the ©Gownow format.
The
only information that electronic directories applications provide to the
customer is a telephone number. ©Gownow would show whether the provider is online or not (available or not)
making it easier for the customer and the provider to exchange information in
order to place an order or to determine when a service should be provided. It
would also be possible for the customer to pay for the product or service
within the format (several payment methods, online or otherwise, which
could be the ©Gownow payment
method among other options). That is, with ©Gownow consumers would be
better serviced than with the existing websites/applications for searching in
electronic directories and otherwise.
When buying a product or
service, in case it is for delivery, the ©Gownow format could indicate
the location of the service provider or the cell phone of the delivery person
so that the customer can be aware of how distant the product/service provider
is from him/her by means of the GPS location of their cell phones (as indicated
subsequently in the ©Gownow sample screens in application format).
